Our youth baseball training program is designed to build strong foundations in athletic performance, game skills, and character. 1. Assumption of Risk
I understand that participation in baseball training, games, events, travel, conditioning, and other related activities involves inherent risks, including but not limited to physical injuries (e.g., fractures, concussions, heat-related illness), property damage, illness (including exposure to contagious diseases), and even death. I voluntarily and knowingly assume full responsibility for any and all risks, known or unknown, associated with such activities.
2. Release and Waiver
To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless the Released Parties from any and all liability, claims, demands, losses, causes of action, or lawsuits of any kind, whether in law or equity, that may arise from injury, illness, disability, death, or property damage suffered by the Participant while participating in activities sponsored or conducted by Absolute Kids.org or Riverside Bombers Baseball Academy.
3. Covenant Not to Sue
I agree not to sue or bring any legal action against the Released Parties for any injury or damage sustained, whether caused by the negligence of the Released Parties or otherwise, arising out of participation in any activity associated with these organizations.
4. Indemnification
I further agree to indemnify and hold harmless the Released Parties against any and all claims, suits, damages, costs, and attorney's fees arising from my (or my child's) participation in these activities, including claims brought by third parties.
5. Medical Authorization
I authorize the staff or coaches to obtain necessary emergency medical treatment for the Participant in the event of injury or illness. I agree to be responsible for any and all medical expenses incurred on behalf of the Participant.
6. Media Release
I give permission for photos, videos, or audio recordings taken during activities to be used for promotional or educational purposes by Absolute Kids.org and Riverside Bombers Baseball Academy without compensation or further consent. 7. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. Acknowledgment of Understanding
I HAVE CAREFULLY READ THIS RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
